Terminals for Private Interest (TUKS) and Special Terminals (Tersus) are port facilities built and operated by business entities to support certain business activities and not for public services. TUKS itself is within the public port area and is used for private interests according to permits, while Tersus is outside the public port area and is used specifically to support the owner's business activities. The legal basis for its regulation is Law Number 17 of 2008 concerning Shipping and Government Regulation Number 61 of 2009 concerning Ports. The technicalities for submitting permits are regulated in the Regulation of the Minister of Transportation Number PM 51 of 2015.

Requirements TUKS/Tersus

The following are the detailed requirements for TUKS and Tersus, grouped for clarity :

1. Persyaratan Administratif

  • Surat permohonan kepada Menteri Perhubungan melalui KSOP/KUPP setempat;

  • Nomor Induk Berusaha (NIB);

  • Akta pendirian dan pengesahan badan usaha (jika berbadan hukum)

  • Bukti penguasaan/pemilikan lahan dan perairan (sertifikat, perjanjian sewa, atau izin pemanfaatan);

  • KKPR dan PKKPRL;

  • Persetujuan lingkungan (UKL-UPL/AMDAL);

  • Rekomendasi pemerintah daerah dan/atau instansi teknis terkait;

2. Persyaratan Teknis

  • Studi kelayakan (feasibility study) teknis dan ekonomi;

  • Rencana Induk TUKS/Tersus dan rencana pengembangan;

  • Gambar teknis: layout lokasi, dermaga, trestle, causeway, kolam pelabuhan, dan alur pelayaran;

  • Data hidro-oseanografi dan bathimetri;

  • Rencana Sarana Bantu Navigasi Pelayaran (SBNP) bila diperlukan;

  • Rencana fasilitas pokok dan penunjang (dermaga, lapangan penumpukan, gudang, utilitas);

  • Rencana keselamatan, keamanan pelayaran, dan ISPS Code (jika wajib);

  • Kesiapan operasional, SDM kepelabuhanan, serta sistem pengawasan;

3. Ketentuan Khusus

  • TUKS : berada di dalam wilayah pelabuhan umum dan wajib mendapat persetujuan pengelola pelabuhan;

  • Tersus : berada di luar wilayah pelabuhan umum dan wajib memiliki alur sendiri atau alur yang disetujui.
